REGULATIONS OF MILOUT.PL INTERNET STORE as of 30.12.2021

I. Definitions

The terms used in the Regulations shall mean:
  1. Customer - a natural person, a legal person or an organisational unit which is not a legal person and to which special provisions grant legal capacity, who makes an Order from the Store.
  2. Seller - hereinafter referred to as SPC - operator of the milout.pl shop: SPC - TOMASZ KITA Spółka Komandytowo-Akcyjna, ul. Tadeusza Kościuszki 114 2N, 61-717 Poznań, NIP 7831847671, KRS: 0000938196 oraz REGON 52067408, tel: +48 533 372 997, e-mail: info@milout.pl
  3. Consumer - in accordance with Article 22[1] of the Civil Code means a natural person making a legal transaction with an entrepreneur which is not directly connected with his/her business or professional activity.

  5. Civil Code - the Act of 23 April 1964. (Journal of Laws No. 16, item 93 as amended);
  6. Regulamins - these Regulations for the provision of electronic services within the milout.pl Internet Shop;
  7. Internet shop (Store) - the Internet service available under milout.pl, through which the Customer may in particular place Orders;
  8. Goods - products presented in the Internet Shop;
  9. Contract of Sale - a contract for the sale of Goods, as defined by the Civil Code, concluded between SPC and the Customer, entered into using the website of the Store;
  10. Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
  11. Act on the provision of services by electronic means - Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204 as amended);
  12. Order - Customer's declaration of will, aiming directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

II. General provisions

  1. The present Regulations define the principles of using the online shop available at: milout.pl.
  2. The present Regulations are the regulations referred to in article 8 of the Act on providing services by electronic means.
  3. The Internet shop, operating at the address: milout.pl, is operated by SPC
  4. These Regulations define in particular:
    1. Rules for registration and use of an account in the online shop;
    2. Conditions and rules for registration
    3. conditions and rules for electronic reservation of products available as part of the online shop;
    4. conditions and rules for electronic submission of Orders within the online shop
    5. conditions and rules for electronic submission of Orders as part of the online shop;
    6. respectively
    7. principles of concluding Sales Agreements using the services provided by the online shop;
  5. The use of the online shop is possible on condition that the ICT system used by the Customer meets the following minimum technical requirements:
    1. Internet Explorer version 10 or higher with JavaScript enabled, or
    2. Chrome version 49 or higher with JavaScript enabled, or
    3. Firefox version 43 or later with JavaScript enabled, or
    4. Microsoft Edge version 13 or later with JavaScript enabled, or
    5. Opera version 36 or later with JavaScript enabled, or
    6. Safari version 4 or later with JavaScript enabled
  6. In order to use the online shop, the Customer shall himself/herself have access to a computer workstation or a terminal device with Internet access.
  7. In accordance with applicable law, SPC reserves the right to restrict the provision of services via the Online Shop to persons over the age of 18. In this case, potential customers will be notified of the above.
  8. Customers may access these Regulations at any time through the link on the home page of milout.pl and download and make a printout.

III. Rules of using the Internet Shop

  1. To start using the Online Shop, it is necessary to register with it.
  2. Registration takes place by completing and accepting a registration form which is available on one of the pages of the Store.
  3. Registration is conditional on accepting the Terms and Conditions and providing the personal data indicated as obligatory
  4. SPC may deprive the Customer of the right to use the Online Store, as well as restrict its access to a part or all resources of the Online Store, with immediate effect, in the case of violation of the Terms and Conditions by the Customer, and in particular if the Customer:
    1. declared untrue, inaccurate or outdated data during registration at the Online Shop, misleading or violating the rights of third parties
    2. has, by means of the Online Shop, violated the personal rights of third parties, in particular the personal rights of other customers of the Online Shop,
    3. abuses other behaviour, which will be considered by SPC as behaviour contrary to the applicable laws or general rules for the use of the Internet or detrimental to the good name of SPC
  5. A person who has been deprived of the right to use the Online Store may not register again without the prior consent of SPC
  6. To ensure the security of the transmission of messages and data in connection with the services provided as part of the Website, the Online Store undertakes technical and organisational measures appropriate to the degree of risk to the security of the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data transmitted on the Internet.
  7. In particular, the Customer is obliged to:
    1. not provide or transmit content that is prohibited by law, such as content that promotes violence, defamatory or violating personal interests and other rights of third parties,
    2. not use the Store.
    3. use the Online Store in a manner not disruptive to its functioning, in particular through the use of specific software or devices,
    4. undertake actions such as: sending or placing unsolicited commercial information (spam) within the scope of the Online Shop,
    5. use the Online Shop in a manner not burdensome to other customers and SPC,
    6. Use all content available in the Online Shop for own personal use only,
    7. use the Online Store in a manner compliant with the provisions of the law in force in the Republic of Poland, the provisions of the Terms of Use, as well as with the general principles of using the Internet.

IV. Procedure for concluding the Sales Agreement

  1. Information about the Goods given on the website of the Store, in particular their descriptions, technical and usable parameters as well as prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  2. In order to conclude a sales agreement via the Internet Shop, it is necessary to enter the milout.pl website, make a selection of goods, taking further technical actions based on messages displayed to the Customer and information available on the website.
  3. The selection of goods ordered by the Customer is carried out by adding them to the shopping cart.
  4. In the course of placing the Order - until the button "Order with obligation to pay" or another equivalent informing about the obligation to pay is pressed - the Customer has the possibility of modifying the entered data and the selected Goods. For this purpose, the messages displayed to the Customer and information available on the website shall be followed.
  5. After the Customer using the Online Store has provided all necessary data, a summary of the Order placed shall be displayed. The summary of the Order shall include information on:
    1. the subject of the order,
    2. the total price of the order.
    3. unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
    4. chosen method of payment,
    5. selected method of payment
    6. the selected method of delivery,
    7. the delivery time,
  6. In order to send an Order it is necessary to accept the content of the Terms and Conditions, provide personal data marked as obligatory and press the button Order with obligation to pay.
  7. Sending an Order by the Customer constitutes a declaration of will to conclude an agreement of sale with SPC, in accordance with the content of the Terms and Conditions.
  8. After placing an Order, the Customer submits the Order to us.
  9. After placing an Order, the Customer receives an e-mail entitled "Order Receipt Confirmation", which contains a final confirmation of all significant elements of the Order.
  10. The Contract shall be deemed to have been concluded upon the Customer's receipt of the e-mail referred to above.

  12. The contract of sale is concluded in the Polish language, with the content compliant with the Regulations.
  13. Customers may access these Regulations at any time through the link on the homepage of milout.pl and download and make a printout.

  15. Preserving, securing and making available data on the Order and the General Terms and Conditions (regulations of the online shop) shall take place via e-mail.

V. Delivery

  1. Delivery of the placed order is limited to the area of the Republic of Poland and takes place to the address indicated by the Customer when placing the order. Delivery does not apply to firearms, ammunition or pyrotechnics.
  2. Delivery of the ordered goods is not possible.
  3. Delivery of the ordered Goods is carried out by GLS and UPS courier, 24/7 Paczkomaty service and inPost Kurier.
    Delivery costs are:
    • Paczkomaty 24/7 - 8,90 zł order with prepayment;
    • InPost Kurier
    • InPost Courier - 9,90 zł an order with prepayment, 13,90 zł on delivery
    • GLS - 9,90 zł an order with prepayment, 13,90 zł on delivery;
    • UPS - 15,90 zł an order with prepayment;
    • UPS - 15,90 zł an order with prepayment;
    • UPS - 15,90 zł an order with prepayment
    • UPS - 15,90 zł order with prepayment, 19,90 zł cash on delivery;
  4. Delivery costs will also be indicated at the time of placing the Order;
  5. The delivery period is from 1 to 7 working days from the day the Customer sends the Order.

VI. Prices and payment methods

  1. The prices of the Goods are given in Polish zloty and in Euro and include all components, including VAT (with a distinction of the rate), customs duties and any other components.
  2. The Customer has the option to pay the price:
    1. by transfer to a bank account number,
    2. by bank transfer
    3. payment in the electronic banking system on the milout.pl shop website,
    4. payment on delivery of the goods,
    5. payment in the electronic banking system on milout.pl
    6. payment on delivery of goods,
  3. Discounts in the online shop, if not stated otherwise, do not include shipping service, collection, installment credit fee, PayPal fee, bank fee and other technical fees. The discount does not apply to products in the weapons and ammunition category.

VII. Right of withdrawal

Only the Customer who is also the Consumer shall have a 30-day period to withdraw from the contract. The consumer has the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period shall expire after 30 days from the day on which you acquire possession of the item or on which a third party other than the carrier and indicated by you acquires possession of the item.

To exercise your right of withdrawal, you must inform us SPC, Kościuszki 114 2N, 61-717 Poznań, info@milout.pl of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).

You may also fill in and submit a withdrawal form or any other unequivocal statement electronically on our website milout.pl. If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by e-mail) without delay.

In order to comply with the withdrawal period, you must make your declaration in writing.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

The consumer may not withdraw from the contract of sale in the case of the purchase of an item manufactured/modified according to the customer's specifications, and also in the case where the product is delivered in sealed packaging which, once opened, cannot be returned for health protection or hygiene reasons.

Effects of withdrawal

In the event of withdrawal from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the extra costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without delay and in any event not later than 14 days from the day on which we are informed about your decision to exercise your right of withdrawal from this contract. We will reimburse you using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of this reimbursement.

We may withhold reimbursement until we receive the item or until you provide us with proof of return. Please send back or hand over the item(s) to us immediately and in any event no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the item(s) before the period of 14 days has expired. You will have to bear the direct costs of returning the item. You shall only be liable for any diminished value of the goods resulting from the use of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.

VIII. Complaints about Goods

  1. SPC as a seller is liable to a Customer who is a Consumer within the meaning of Article 22[1] of the Civil Code, under warranty for defects to the extent specified in the Civil Code, in particular in Article 556 and Articles 556[1] to 556[3] et seq.
  2. Complaints arising from the violation of rights guaranteed by law or under these Regulations should be addressed to reklamacje@spechurt.pl. SPC undertakes to consider each complaint within 14 days. Failure to consider a complaint within this period means that the complaint is considered justified.
  3. SPC is not the manufacturer of the goods. The Manufacturer shall be liable under the warranty for the Goods sold under the conditions and for the period indicated in the warranty card. If the warranty document provides for such a possibility, the Customer may submit its claims under the warranty directly to the authorised service centre whose address is indicated in the warranty card.

IX. Complaints concerning the provision of electronic services

  1. SPC takes actions in order to ensure fully proper functioning of the Store, to the extent resulting from the current technical knowledge, and undertakes to remove all irregularities reported by the Customers within a reasonable time.
  2. The Customer is obliged to immediately notify SPC of any irregularities or interruptions in the functioning of the Online Shop service.
  3. The Customer may report irregularities related to the functioning of the Store in writing to the address: SPC, Kościuszki 114 2N, 61-717 Poznań, by e-mail at info@milout.pl or by using the contact form.
  4. Complaints should be sent to the following address
  5. In a complaint, the Customer should provide his/her name, correspondence address, type and date of irregularity related to the functioning of the Store.
  6. SPC undertakes to examine each complaint within 14 days. Failure to consider a complaint within this period means that it is considered justified.

X. Dispute resolution and final provisions

  1. Customers who are Consumers may, if they are interested, make use of out-of-court ways of dealing with complaints and asserting claims. Disputes concerning online shopping can be resolved through mediation proceedings before the Provincial Inspectorates of Trade Inspection or through a trial before an arbitration court at the Provincial Inspectorate of Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and e.g. file his/her complaint via the EU online ODR platform available at: http://ec.europa.eu/consumers/odr/
  2. In the absence of interest on the part of the Consumer in the use of out-of-court dispute resolution methods, the settlement of any disputes arising between SPC and the Consumer will be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
  3. Settlement of any disputes arising between SPC and a Customer who is not a Consumer shall be submitted to the competent court for the registered office of SPC
  4. In matters not covered by these Terms and Conditions the provisions of the Civil Code, provisions of the Act on provision of services by electronic means and other relevant provisions of Polish law shall apply.
